Q. Who makes the laws for child protection?

I am writing an essay on "should smoking in a enclosed space with a child be considered child abuse" I am just trying to find out who would pass a law like that.

Some child protection and child welfare laws are passed at the Federal level, but the majority of child welfare laws and services are handled at the State level. In Michigan, child protection or child welfare laws would be passed by the Michigan legislature.
